1. PAYMENT: A deposit of 40% of the invoice, including taxes and delivery fees, is required for instore or by telephone purchases. This deposit is referred to as the "Deposit."

2. METHODS OF PAYMENT: Maximum 40% by credit card. Balance payable 3 days before delivery by interac, bank draft or cash.

3. RETURNS AND CANCELLATIONS: Goods cannot be modified, returned, or canceled once the purchase is made.

4. CHOICE AND RECEIPT OF GOODS: The customer acknowledges that the goods identified in the contract are their own choice, and they take full responsibility for accepting them upon delivery.

5. VARIATIONS IN DIMENSIONS, COLORS, AND MATERIALS: Due to the handmade nature of our furniture, the dimensions may vary slightly. As well as, variations in color, fabric, and leather can occur.

6. DELIVERY CHARGES: Delivery charges include a two-person delivery team. An additional charge of $125 applies if extra personnel are required.

7. ACCESS RESPONSIBILITY: The customer is responsible for ensuring sufficient access for delivery. Casavogue is not liable for access limitations. If the goods don't fit inside the customer's home, they must specify an alternative location within the same address for placement. Customer is responsible for managing the furniture once delivered to the designated area. Casavogue is not liable for any issues after delivery. In case of non-availability of the elevators, the deliverers will go up to a maximum of two floors.

8. ACCESS AUTHORIZATION, PREPARATIONS, AND MATERIAL DAMAGES: The client is solely responsible for maintaining a minimum access width of 36 inches from the delivery truck exit. This includes clearing the pathway, snow removal, and taking precautions to prevent accidents during the delivery. The client must inform the concierge in advance and provide protective equipment for common areas. Casavogue disclaims any responsibility for material damages that may occur during the delivery process.

9. ABSENTEEISM AND ADDITIONAL DELIVERY CHARGES: If the customer is absent on the delivery date, a rescheduled delivery should occur within 5 business days from the original date, and a new delivery fee will be charged at the same rate as the original delivery. In the event that the customer cancels the appointment within 72 hours of the scheduled delivery, whether for absence or appointment cancellation, a fee of $350 plus taxes will be charged.

10. MANUFACTURER DELIVERY DELAYS AND PARTIAL DELIVERY : Casavogue is not responsible for delivery delays caused by manufacturers of the purchased goods. In the case of delayed goods, Casavogue may proceed with a partial delivery without additional charge to the customer for the undelivered items. However, the customer must pay the full amount for the delivered items. The Deposit for goods experiencing a delivery delay will be retained, and the customer cannot cancel the undelivered goods due to the delay.

11. POSSESSION, BALANCE PAYMENT AND STORAGE: Once the merchandise is ready for full or partial delivery (in case of manufacturer's delay), the customer must take possession of it and pay the remaining balance to Casavogue. If the customer refuses to schedule a delivery date, storage charges of $350+taxes apply for a maximum period (see clause 12).

12. CONTRACT VALIDITY AND DEPOSIT: The contract remains valid for a period of three months from either the scheduled delivery date or the date when the goods are ready to be delivered by Casavogue. If the client fails to accept the delivery within this timeframe, Casavogue reserves the right to consider the contract void. In the event of non-acceptance of delivery by the client after the three-month period, the Deposit will be retained by Casavogue as compensation and will not be refunded. Any furniture held with storage fees must be paid in full. The customer cannot request promotions or price reductions on delivered goods, but Casavogue may adjust the price at the time of delivery.

13. JURISDICTION: The customer chooses domicile in the district of Montreal regarding the contract and these terms and conditions.

14. EXCLUSION OF WARRANTY, INSURANCE AND SERVICE CHARGES: Manufacturer's warranties or insurance plans do not cover labor or Casavogue delivery crews. Casavogue may charge $85 per hour per person, plus applicable taxes, for any intervention.

15. LATE PAYMENT INTEREST: Partial payment of the goods will accrue interest at a rate of 18% per annum from the agreed delivery date between Casavogue and the customer. If no specific delivery date is set, interest will start accruing no later than five days following Casavogue's call to schedule the delivery, whether partial or complete.

16. CASAVOGUE'S RIGHT TO PAYMENT: Casavogue's failure to demand full payment for the goods cannot be interpreted against it, as payment remains the responsibility of the customer
